1. About these terms

These Terms of Use apply to flourcityphotobooth.com and related pages, including booking pages (the "site"). The site is operated by Total BS LLC, doing business as Flour City Photo Booth Co., in Rochester, New York ("we," "us," or "our"). By using the site, you agree to these terms. If you do not agree, please do not use the site.

If you book an event with us, your rental agreement also applies. If the rental agreement conflicts with these terms, the rental agreement controls for your event.

2. Using the site

  1. You may use the site to learn about our services, request quotes, manage bookings, and view event galleries.
  2. You agree to provide accurate information when you submit forms.
  3. You agree not to misuse the site, including by sending spam, trying to access areas or data you are not authorized to access, interfering with the site's operation, or using automated tools to collect content.
  4. If you have access to a booking page or gallery, please keep the link private. Anyone with the link may be able to view it.

3. Prices and quotes

We try to keep prices on the site accurate and current, but prices may change and errors can happen. The price in the written quote or on your booking page is the price that applies to your event. Prices shown elsewhere on the site are for general information only and are not an offer.

4. Travel estimates

Any travel fee or distance shown on the site is an estimate based on the information you provide. The final travel fee will be shown in your quote or on your booking page.

5. Intellectual property

The site's content, including text, images, graphics, logos, and design, belongs to us or our licensors and is protected by copyright and trademark law. You may view and share pages for personal, non-commercial purposes. You may not copy, modify, or reuse our content for commercial purposes without our written permission. Event photos are covered by your rental agreement.

6. Partner program

We offer a referral program for partners such as venues, planners, and other vendors. In brief:

  1. A partner earns a referral reward when an event booked through their referral code or link is completed.
  2. Rewards are paid within 14 days after the referred event takes place.
  3. If more than one referral code is associated with a booking, the first code we recorded wins.
  4. We may void referrals for self-referral, fake or duplicate bookings, spam, or other abuse of the program.
  5. We may change or end the partner program at any time. Rewards already earned for completed events will still be paid.

Additional partner terms may be provided when you join the program.

7. Third-party links and services

The site may link to or use third-party websites and services, such as our payment processor or venue websites. We do not control those sites and are not responsible for their content, policies, or practices. Your use of them is subject to their own terms.

8. Disclaimers

The site is provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties, express or implied, about the site, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not promise that the site will always be available, error-free, or free of viruses or other harmful components.

9. Limitation of liability

To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the site. Our total liability for any claim related to the site is limited to $100. This section does not limit our obligations under a signed rental agreement, which has its own terms.

10. Changes to these terms

We may update these terms from time to time. When we do, we will change the "Last updated" date at the top. Continuing to use the site after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of New York. Any dispute related to the site will be handled in the state or federal courts located in Monroe County, New York.
